Terms of Service

Welcome to TourneyOS! These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the TourneyOS website located at https://tourneyos.com, along with any related software, platforms, features, and services (collectively, the “Platform”).

By registering an account, purchasing a subscription, or otherwise accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must strictly refrain from using our Platform.

1. Acceptance of Terms & Age Restrictions

By accessing or using the Platform, you represent and warrant that you meet the following minimum age requirements:

  • Global Users (excluding EU/EEA/UK): You must be at least thirteen (13) years of age.
  • EU/EEA/UK Users: Due to the GDPR and equivalent laws, you must be at least sixteen (16) years of age.
  • Premium Subscriptions & Purchases: To purchase a Premium subscription or any paid features, you must be at least eighteen (18) years of age or have reached the age of legal majority in your jurisdiction.

TourneyOS reserves the right to immediately terminate any account that violates these age restrictions.

2. Account Registration & Security

To participate in tournaments and access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

You are solely and exclusively responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify TourneyOS immediately of any unauthorized use or suspected security breach. TourneyOS cannot and will not be liable for any loss, damage, or unauthorized access arising from your failure to protect your login credentials.

3. Subscriptions, Auto-Renewal & Billing

TourneyOS offers Premium accounts billed on a recurring subscription basis (“Subscriptions”).

  • Auto-Renewal: By purchasing a Premium subscription, you expressly authorize TourneyOS and our third-party payment processors (e.g., Stripe, PayPal) to automatically charge your designated payment method on a recurring basis at the then-current rate. Your subscription will automatically renew at the end of each billing cycle until you explicitly cancel it.
  • Cancellation:You may cancel your Subscription's auto-renewal at any time via your Account Settings on the Platform. Cancellation will take effect at the end of your current paid billing cycle.

4. Refund Policy

  • No Prorated Refunds: All sales and charges are final. TourneyOS does not offer partial or prorated refunds for unused days or months if you cancel your Subscription prior to the end of your billing cycle.
  • EU/EEA/UK Right of Withdrawal & Express Waiver: By proceeding with your Premium purchase, you expressly consent to the immediate provision of the digital services. You acknowledge that as soon as you utilize any Premium features, you thereby waive your statutory 14-day right of withdrawal.

5. Code of Conduct, Anti-Cheat & Termination

Any violation of this Code of Conduct constitutes a Material Breach of these Terms. TourneyOS reserves the absolute right to suspend or permanently ban your account at our sole discretion, immediately and without prior notice. If your account is terminated for a Material Breach (including cheating or toxicity), all active subscriptions will be immediately revoked, and you will not be entitled to any refund for the remaining subscription period.

6. Changes to Terms

TourneyOS reserves the right, at our sole and absolute discretion, to modify, amend, or update these Terms at any time. If we make material changes to this Agreement, we will provide reasonable notice by updating the “Last Updated” date at the top of this document, and/or by displaying a prominent notification on the Platform. Your continued access to or use of the Platform following the effective date of such modifications constitutes your explicit acceptance of the revised Terms.

7. Prize Pools, Payouts & Taxes

Certain tournaments hosted on the Platform may offer monetary prize pools or other rewards (“Prizes”). By participating in such events, you acknowledge and agree to the following conditions:

  • Tax Liability: You are solely and exclusively responsible for the calculation, declaration, reporting, and payment of any and all applicable taxes associated with your receipt of any Prizes.
  • KYC & Identity Verification: As a strict condition precedent to the disbursement of any Prizes, TourneyOS reserves the right to require you to successfully complete a “Know Your Customer” (KYC) identity verification process.
  • Fraud & Prize Freezing: TourneyOS retains the absolute right to freeze, withhold, delay, or entirely revoke any pending Prize payouts if we possess reasonable suspicion that you or your team engaged in cheating, match-fixing, or fraud.

8. User Generated Content (UGC) & DMCA Safe Harbor

  • User Responsibility: You retain all rights to your UGC but grant TourneyOS a non-exclusive, worldwide, royalty-free license to host, display, and distribute it on the Platform.
  • Platform Liability: TourneyOS acts strictly as an intermediary service provider and assumes no liability for user-uploaded content.
  • DMCA Takedown Notices: If you are a copyright owner and believe your work is being infringed upon, please submit a formal takedown notice to our designated Copyright Agent at legal@tourneyos.com.

9. Limitation of Liability & Disclaimer of Warranties

The Platform and all services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, TourneyOS explicitly disclaims all warranties, whether express or implied.

In no event shall TourneyOS, its directors, employees, affiliates, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.

10. Governing Law, Jurisdiction & Class Action Waiver

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba, and the federal laws of Canada applicable therein. You explicitly agree to submit to the exclusive personal jurisdiction and venue of the courts located in Winnipeg, Manitoba, Canada.

Class Action Waiver: To the fullest extent permitted by applicable law, you and TourneyOS explicitly agree that each party may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, collective, or representative proceeding.
